Realcomp Listing Policies

This document is intended to fully explain the options subscribers of Realcomp MLS have available to them when listing properties. Please let us know if you have questions regarding these policies.

Clear Cooperation

Realcomp’s rules require that within one (1) business day of marketing a property to the public, the Listing Broker must disseminate the listing to the MLS for cooperation with other Participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (i.e., email blasts), multi-brokerage listing sharing networks, and applications available to the general public. This is applicable to all property types permitted in the MLS with the exclusion of leases, commercial properties, and new construction developments with multi properties.

Different Types of Listings Offered Through Realcomp

Coming Soon Listings

If a new listing is not available to be shown, it must be placed in the Coming Soon status. An Activation Date is specified on the listing to indicate when the listing will convert to the Active status and showings can begin. The Activation Date must be within five (5) business days of entry. Listings placed in the Coming Soon status cannot be shown by anyone including the listing office during the Coming Soon time period. Additionally, the following will apply for all listings in the Coming Soon status:

  1. All required fields are necessary to submit the listing to the MLS;
  2. A primary photo and listing documents must be attached within 48 hours;
  3. Listings in the Coming Soon status are permitted to have an open house or broker tours scheduled to take place only on or after the activation date;
  4. Coming Soon listings are not permitted to be marketed in a manner other than Coming Soon. While in the Coming Soon status, the property is viewable by the general public with the Coming Soon banner and the Activation Date conspicuously displayed;
  5. Coming Soon listings will automatically move to the Active status at 12:00 AM on the recorded Activation Date;
  6. While in the Coming Soon status, the Listing Agent/Broker can change the status of the listing to Active (ahead of the Activation Date), Conditionally Withdrawn (Hold), or Unconditionally Withdrawn (Canceled);
  7. Once a Coming Soon listing changes to Active, it must remain Active and be available for showings and cooperation for a minimum of 24 hours; and
  8. A property that was entered as Coming Soon cannot be relisted again as Coming Soon by the same brokerage for 90 days.

Failure to comply with the Coming Soon rules may result in the following fines:

  1. First Occurrence: $1,000 fine, Agent required to attend training on Coming Soon rules, and notification of fine to Broker.
  2. Second Occurrence: $2,000 fine, and requirement for Agent and Broker to attend training on Coming Soon rules.
  3. Third Occurrence: $5,000 fine, requirement for Agent and Broker to attend training on Coming Soon rules, and possible suspension to be determined by the Realcomp MLS User Committee. In addition, the third occurrence will result in the requirement that the Agent and Broker appear before the Realcomp MLS User Committee to offer an explanation for the continued violation of the rule. Also, the information will be forwarded to the appropriate Shareholder for review to determine if there has been a violation of the NAR Code of Ethics.

Office Exclusive Listings

If the seller has directed the listing broker to not publicly market their property and to not disseminate it through the MLS to other MLS Participants and Subscribers, the Listing Participant may then take the listing as an office exclusive exempt listing and such listing shall be filed with the MLS, but not disseminated to other MLS Participants and Subscribers.

Delayed Marketing Listings

If the Seller has directed the Listing Broker to delay the public marketing of their property through IDX and syndication, the listing shall be filed with the MLS and disseminated only to other MLS Participants and Subscribers. The Listing Agent/Broker shall appropriately select the field in the MLS listing entry program indicating this choice. The Listing Broker is not precluded from marketing the delayed marketing exempt listing in a manner consistent with the seller’s choice.

 

When filing an exempt listing, either office exclusive or delayed marketing, with the MLS, the Listing Agent/Broker must include a certification, signed by the seller, which includes:

  1. Disclosure about the professional relationship between the Participant and the seller;
  2. Acknowledge that the seller understands the MLS benefits they are waiving or delaying with the exempt listing, such as broad and immediate exposure of their listing through the MLS; and
  3. Confirmation of the seller’s decision that their listing  is not publicly marketed and disseminated by the MLS to other MLS Participants and Subscribers as an office exclusive listing, or that their listing will not have immediate public marketing through IDX or Syndication as a delayed marketed listing.

Note: These options are designed to give the consumers greater choice and flexibility in marketing their homes for sale.
